Terms of Service

1. Who we are and your acceptance of these terms

iLactation Limited ("iLactation", "we", "us") is a company incorporated in Hong Kong with its registered office at 16/F Wing Hing Commercial Building, 139 Wing Lok Street, Sheung Wan, Hong Kong.

We run online continuing-education conferences for lactation care providers and healthcare professionals. Our learning platform is available at edu.ilactation.com and at our Spanish and Dutch language sites (together, the "Platform"). We provide an optional recertification tracking application for users to help keep track of continuing-education activity and the user recertification cycle in one place (“the Recertification Tracker”, “the Tracker”). These Terms of Service ("Terms") govern your use of the Platform and the Tracker, your registration for our conferences, and the content we make available to you.

By creating an account, registering for a conference, using the Recertification Tracker or otherwise using the Platform, you confirm that you have read these Terms and that you accept them. If you do not accept them, please do not use the Platform or the Tracker.

These Terms sit alongside our Privacy Policy, which explains how we handle your personal data. Where a conference page or a registration confirmation sets out terms specific to that conference (for example, its access window or the credits available), those specific terms apply in addition to these Terms.

2. Your account

You need an account to register for a conference and to watch presentations. You need an account to register for and use the Recertification Tracker.

Accuracy. You must give us accurate registration details and keep them up to date. The name on your account is the name that will appear on any certificate you generate, and accrediting bodies expect that name to match your professional records.

One account per person. Accounts are personal to you. You may not create an account on behalf of someone else without their knowledge, hold more than one account, or let another person use your account. Continuing-education credit is awarded against the account that watched the presentation. Log-in credentials must not be shared. If credentials are found to have been shared, no valid credit will be available for either person and section 11 applies.

Security. You are responsible for keeping your password confidential and for activity that takes place under your account. Tell us promptly at the address in section 16 if you believe your account has been accessed without your permission.

Minimum age. You must be at least 18 years old to hold an account.

Group registrations. We accept group registrations of six or more participants. One invoice is issued to a nominated payer, who is responsible for payment on behalf of the group. Participants cannot be added to a group once the invoice has been issued. When payment has been received, we email individual log-in details to each participant. Group members hold their own individual accounts, and every member of a group must comply with these Terms in their own right.

3. Registrations, education access windows and payment

Registration. Access to education is sold per conference. Registering for one conference does not give you access to any other conference. We accept registrations before a conference opens and during the conference up to and including its final day. Late registrations pay the full price, and access ends at the same time for every participant regardless of when they registered.

Prices. All prices are shown in US dollars unless the Platform states otherwise. Our prices do not include VAT or any equivalent sales tax, and we do not add such tax at checkout. If your own tax authority treats your registration as taxable in your country, meeting that obligation is your responsibility.

Currency conversion charges. If your card or bank account is held in another currency, your card issuer or bank may apply its own exchange rate and its own foreign currency or foreign transaction charge. Those charges are a matter between you and your card issuer or bank, and they are your responsibility.

Payment. Payment on the Platform is taken by our payment processor, Stripe. We do not store your full card details. Where we agree an alternative payment route with you (for example PayPal or a bank transfer against an invoice), your education access begins when we have confirmed that payment has cleared.

Education access window. Each conference has a stated opening date and closing date. Your education access runs for that window and ends when the window closes, whether or not you have watched all of the presentations. The education access window is the same for every participant and we do not extend individual education access windows.

Watch-only tickets. Some ticket categories are sold as watch-only. A watch-only ticket is designed primarily for volunteer breastfeeding supporters. It lets you view the presentations during the access window but does not earn continuing-education credit and does not produce a certificate. Where a ticket is watch-only, this is stated clearly on the conference page before you pay. If you buy a watch-only ticket you cannot later claim credit for presentations you watched under it.

Technical requirements. Watching presentations requires a device with a working internet connection and audio output. Slower connections affect loading speed and picture quality. We publish free presentations which can be accessed prior to purchasing a paid conference registration, and which you can use to check your device setup. We are not responsible for your device specification, your network, or your local IT restrictions, and we recommend you test your setup before registering rather than after.

Newsletter. Registering for a conference or to use the Tracker does not add you to our mailing list. We send conference updates, news, event announcements and other marketing emails only to people who have joined our mailing list, and every such email contains an unsubscribe link you can use at any time. Our Privacy Policy explains how we handle your contact details.

4. Refunds, cancellations and substitutions

Cancellation by you. Cancellation and refund requests must be made in writing to the address in section 16.

If we receive your request before the conference opens, we will refund your registration fee less a US$40 administration fee. If we receive your request after the conference has opened, no refund is available.

Immediate supply of an open conference. Where a conference is already open at the time you register, we supply the presentations to you immediately, so that you can begin watching straight away. By completing your purchase you expressly request that immediate supply. If you are a consumer resident in the European Union, the United Kingdom or the EEA, you also acknowledge that once supply has begun you lose the statutory right to withdraw from the contract. We ask you to confirm that request and that acknowledgement at checkout before payment is taken, and we keep a record of your confirmation.

What is not refundable. We do not refund for technical failures on your side, for failing to log in during the access window, or for failing to watch all of the presentations you intended to watch. Registration buys access for the window, not a guaranteed number of credits.

Substitute participants. If you cannot attend, we will accept a substitute participant provided you tell us before the conference opens. After the conference opens we cannot accept substitutions, because watching records and credit are tied to the individual account.

Cancellation by us. If we cancel a conference before it opens, we will refund your registration fee in full. If we have to withdraw a specific presentation after a conference has opened, we will tell registered participants and, where the withdrawal materially reduces the credits available, we will offer a fair partial refund or a credit against a future conference.

5. Credits and certificates

How credit is earned. Continuing-education credit is earned by watching a presentation. There is no quiz or attestation step. A presentation is recorded as complete when you have watched at least 95% of it while signed in to your own account. You cannot claim credit for a presentation you have not watched. You must not sign in to another person's account, or allow another person to use yours, in order to claim credit; where that happens, both the account holder and the person watching are subject to sections 8 and 11.

Own account only, no group viewing. Credit is available only to the person who watched the presentation while signed in to their own account. Watching as a group on a single registration, for example showing a presentation to colleagues in a team meeting or a training session, earns no credit for anyone present, including the account holder, unless we have authorised the arrangement in writing in advance. We do not offer institutional, site or group viewing licences. Each person who needs credit must hold their own registration and watch under their own account.

View tracking. Our accrediting bodies require us to track video viewing in order to evidence attendance. We record viewing against your account and log-in activity. Those viewing records, rather than the certificate itself, are what we rely on in an IBLCE provider audit or an IPMA record request. Section 13 and our Privacy Policy explain how we handle that data.

Accrediting bodies. The credits available for a conference are stated on the conference page. iLactation is accepted as a current preferred provider with IBLCE and as such is bound by the rules for IBLCE preferred providers. Our CERPs can be used towards recertification for IBCLC and CLC certificants and towards other credentials. CME and CNE points are awarded by the Interstate Postgraduate Medical Association, and we have no control over the number or type of points awarded for a given conference, which may change.

The rules of the accrediting body always govern how credit may be used. The IBLCE self-assessment process requires you to allocate your CERPs to the topic areas identified in your Personalised Professional Development Plan, against the IBCLC Detailed Content Outline. You should check the Detailed Content Outline yourself to confirm that a presentation aligns with the area you need. Any topic area labels we publish for conferences from late 2021 onwards are suggestions only.

No guarantee of third party acceptance. Professional bodies around the world set their own requirements for continuing education and recertification. Many accept international certificates, but not all do. It is your responsibility to check what your own regulator or professional body requires before you register. We cannot guarantee that any third party will accept a certificate we issue.

Certificates. You generate and download your own certificates from the Platform. You may generate a certificate at any time once you have completed at least one presentation, either per presentation or once at the end, and you may download it as many times as you like. You may generate more than one certificate type where several are available for your credential. Only presentations completed in full appear on a certificate.

Anyone who needs to verify a certificate, such as an employer or an auditing body, can contact us and we will confirm whether it corresponds to a certificate we issued and to the presentations shown on it.

Watch-only tickets, as set out in section 3, do not produce certificates. No credits are provided and nothing watched under a watch-only ticket can be used for Individual CERPs or "self-CERPs".

6. Recertification Tracker

The Recertification Tracker is an optional feature that helps you keep track of your continuing-education activity and your recertification cycle in one place. You choose whether to turn it on, and it has its own consent step inside the Platform before it stores anything about you.

Automatic tracking of iLactation conference credits. If the Tracker is turned on, the presentations you watch at iLactation conferences are counted automatically and stored in the My Credits section of the Tracker.

Your data, your responsibility. The Tracker holds information you give it, including records of education you completed elsewhere. We do not verify third party records. The accuracy and completeness of what you enter, and of what you rely on when you submit a recertification application, remain your responsibility. You may delete your data from the Tracker at any time.

AI document reading. The Tracker can optionally read certificates and similar documents you upload and suggest values to save you typing. This feature is off unless you turn it on and turning it on is a separate consent. Automated reading is assistive only. It can misread a document. You should check every suggested value before you accept it, and nothing is saved to your record without your confirmation.

Not professional advice. The Tracker is a record-keeping aid. It does not tell you whether you meet your certifying body's requirements, and any progress indicator it shows is an estimate based on what you have entered. Your certifying body's published rules are the only authority on whether you qualify to recertify.

We may change or withdraw the Tracker, as set out in section 10. If we withdraw it, we will give you reasonable notice and a way to export what you have stored.

7. Intellectual property and licence

Ownership. The Platform and its contents, including presentation video and audio, slides, handouts, text, images, graphics and their arrangement, are protected by copyright and other intellectual property rights and are either owned by iLactation or licensed to us. The Tracker is our intellectual property. The iLactation name, logo and marks are our property. Presenters retain the rights in their own work in accordance with the release each of them has signed with us, and we license that work to you only to the extent those releases allow.

Your licence. When you register for a conference, we grant you a personal, non-transferable, non-exclusive licence to view the presentations included in your registration, during the access window, for your own professional education. The licence includes the download of certain materials from the Platform, such as handouts and your own certificates. Any copy or display you make under this licence must keep any copyright or trade mark notice as it appears on the material.

No copying or capture. You must not make screen recordings or screenshots of iLactation's content, take photographs of it, or capture it digitally by any other means. You must not make derivative works from it.

What else you may not do. You may not broadcast, transmit, download, share digitally, copy, distribute, publish, post, translate, sell, modify or license the presentations or Platform content, or otherwise use them for commercial or public purposes, without our prior written consent. This includes showing a presentation to a group of colleagues on a single registration, and it includes any automated collection or scraping of Platform content. We do not offer institutional or group viewing licences.

Enforcement. If we receive information that content has been captured, shared or copied in breach of this section, we may remove the participant's access to the conference under section 11. In that case no refund and no certificate will be provided. A breach of this section may also result in you being reported to the legal authorities and to your certifying or credentialing body, and we may take legal action.

8. Acceptable use

You agree that you will not:

share your log-in details, or let anyone else watch presentations under your account;

use a robot, scraper, downloader, automated script or any other automated means to access, index or copy the Platform or its contents, or the Tracker;

attempt to bypass, disable or interfere with our view tracking, our certificate generation, our payment processing, or any other security or access control;

probe, scan or test the vulnerability of the Platform, or attempt to gain access to any account, system or data that is not yours;

upload anything to the Platform that is unlawful, that infringes someone else's rights, or that contains malicious code;

do anything that places an unreasonable load on the Platform or degrades it for other participants; or

misrepresent your identity or your professional credentials to us.

We may investigate suspected breaches of this section and take the steps set out in section 11.

9. Educational and medical disclaimer

Our conferences are professional education. They are not clinical direction for the care of an individual patient.

The content is provided for information purposes. It reflects the knowledge and the professional opinions of the presenters at the time of recording. Clinical practice changes, and a presentation recorded some time ago may no longer reflect current guidance. You remain responsible for exercising your own professional judgement and for complying with the standards, protocols and law that apply where you practise.

Presentations may reflect the views or recommendations of presenters and other third parties. Those views do not necessarily reflect ours, and publishing them is not an endorsement of a particular course of action, service or product.

If you are a patient or a parent rather than a health professional, please note that this material is written for clinicians. You should seek help from a healthcare professional in interpreting it and applying it to your own circumstances, and you should consult your doctor about any concern for your own health or your child's health.

Disclosure of interests. The iLactation planning team has no conflict of interest to disclose. Presenters in a position to control the content of an educational activity make individual disclosures of any potential conflict of interest before the activity. Any potential conflict is resolved and noted on the conference disclosures page.

Third party links. Links to third party websites are provided for convenience. We do not control those sites, we are not responsible for their content, and we make no representation about them or about anything found there. You follow such links at your own risk.

10. Availability and changes to the Platform

We aim to keep the Platform available throughout every conference access window, but we do not guarantee uninterrupted or error-free service. Access may be interrupted by planned maintenance, by faults, or by failures at our hosting, video or payment providers.

We schedule planned maintenance outside peak viewing hours wherever we can, and we will give notice on the Platform of any planned work likely to affect access for a material period.

We may add, change, or remove features of the Platform, including changing the design, the video player or the certificate format. We will not make a change that removes access you have already paid for during a conference access window, unless we have to for legal or security reasons.

Despite our efforts, we do not warrant that the Platform is free from viruses or other contamination, and you should maintain your own protections.

11. Suspension and termination

By you. You may stop using the Platform and/or the Tracker at any time and may ask us to close your account. Closing your account does not by itself entitle you to a refund of a registration you have already made, and section 4 continues to apply. We retain the viewing and certificate records we are required to keep for accreditation audit purposes, as described in our Privacy Policy.

By us. We may suspend or terminate your access, remove you from a conference, or close your account if you materially breach these Terms, in particular if you capture or share content in breach of section 7 or share credentials in breach of section 8, or if we are required to do so by law or by an accrediting body.

Where we terminate access for a breach of section 7 or section 8, no refund and no certificate will be provided. In any other case, whether a refund is due is decided under section 4, and we may make a discretionary refund where the circumstances warrant it.

Where the breach is capable of being put right and the circumstances allow, we will normally contact you first and give you a chance to put it right before we suspend or terminate.

12. Our liability to you

Our total liability to you in connection with a conference, however arising, is limited to the fees you paid us for that conference.

We are not liable for loss of profit, loss of business, loss of opportunity, loss of an employment or professional position, or loss of or damage to data, in each case whether or not foreseeable.

We are not liable for a decision made by a third party, including a decision by a certifying or accrediting body not to accept a certificate or credits, or a decision by an employer or regulator.

We are not liable for problems caused by your device, your network or your local IT environment, or for interruptions to third party services outside our reasonable control.

Notwithstanding the above, nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified. If you deal with us as a consumer as defined in section 15, nothing in these Terms affects your statutory rights.

Our conferences are education. Clinical decisions made in reliance on them remain yours, as set out in section 9.

13. Privacy

How we collect, use, store and share your personal data, including your viewing records, your certificate records, and anything you put into the Recertification Tracker, is set out in our Privacy Policy, which is published on the Platform and forms part of your agreement with us. It also explains your rights over your data and how to exercise them.

14. Changes to these Terms

We may update these Terms, for example when we add a feature, change how registration works, or need to reflect a change in law or in an accrediting body's requirements.

Each version of these Terms carries a version number and an effective date, and the current version is always published on the Platform.

Where a change is minor, we will publish the new version and update the effective date. Where a change materially affects your rights or obligations, we will tell you in advance and, when you next sign in, ask you to accept the new version before you continue using the Platform. Records of which version you accepted, and when, are kept in your account.

If you do not wish to accept a new version, you may close your account. Where a material change is made during a conference access window you have already paid for, the version you accepted at registration continues to govern that conference.

15. Governing law and disputes

These Terms and any dispute arising out of them or out of your use of the Platform are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have jurisdiction.

Consumers in the EU, the UK and the EEA. If you are an individual acting as a consumer, that is, for purposes outside your trade, business, craft or profession, and you are resident in the European Union, the United Kingdom or the EEA, nothing in this section limits or excludes any rights or protections you may have under the mandatory consumer laws of your country of residence; those rights and protections continue to apply, and you may bring proceedings against us in the courts of that country.

The preceding paragraph applies only to individual consumers. A registration bought to pursue or improve professional development as part of a trade or profession, or bought by an employer, a hospital, a clinic or any other organisation, including a group registration under section 2, is a business contract and is governed by the laws of the Hong Kong Special Administrative Region and subject to the jurisdiction of the courts of Hong Kong.

General. If any provision of these Terms is found unenforceable, the rest continue in force. Our not enforcing a provision on one occasion does not waive it. You may not transfer your rights under these Terms to anyone else. These Terms, together with the Privacy Policy and any conference-specific terms, are the whole agreement between us about your use of the Platform.
